Terms of Service

1. Definitions

• “Services” means the Zorvetska website and software products, including FinSight, BuzSight AI, and CustomerSight AI.
• “You” or “Customer” means the individual or organization accessing the Services.
• “Content” means data, text, and materials made available through the Services.

2. Eligibility and Accounts

You must have the legal capacity to enter into these Terms and, where you act on behalf of an organization, the authority to bind that organization. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

3. Use of the Services

We grant you a limited, non-exclusive, non-transferable, revocable right to access and use the Services in accordance with these Terms and our Acceptable Use Policy. All rights not expressly granted are reserved.

4. Customer Data and Ownership

You retain ownership of the data you submit to the Services. You grant us a limited licence to process that data solely to provide and improve the Services and as described in our Privacy Policy. We do not claim ownership of your business data.

5. Intellectual Property

The Services, including all software, designs, trademarks, and content provided by Zorvetska, are owned by or licensed to Zorvetska and are protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Services except as permitted by law.

6. Fees and Payment

Where the Services are provided on a paid basis, fees, billing cycles, and payment terms will be set out in an applicable order or agreement. Unless stated otherwise, fees are non-refundable except as required by law.

7. Service Availability

We aim to provide reliable, continuous access to the Services but do not guarantee uninterrupted availability. Planned maintenance and unplanned disruptions may occur. See our Service Availability page for current status information.

8. Third-Party Services

The Services may integrate with or link to third-party services. We are not responsible for the content, policies, or practices of third parties, and your use of those services is governed by their own terms.

9. Disclaimers

The Services are provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. Insights and outputs are provided to support, not replace, your independent judgement.

10. Limitation of Liability

To the maximum extent permitted by law, Zorvetska shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, or data, arising from your use of the Services.

11. Termination

We may suspend or terminate access to the Services for breach of these Terms or where required by law. You may stop using the Services at any time. Provisions that by their nature should survive termination will continue to apply.

12. Governing Law

These Terms are governed by the laws of the Republic of Kenya, without regard to conflict-of-law principles. Disputes shall be subject to the exclusive jurisdiction of the competent courts of Kenya.

13. Changes to These Terms

We may update these Terms from time to time. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
